hehe, nee ik blijf daar ff van af.. gaat te hard (spread) en ligt nooit wat in de bied of laat;) flinterdun boekje. maar ik moet toegeven dat ik wel eens met 5k hoger in de laat de boel naar beneden heb laten gaan, haha.

In het pb van INSM staat dat Insmed de proceskosten in Californie gaat proberen te verhalen op TRCA. Dus als dit wordt uitbetaald kan INSM de proceskosten in Virginia betalen uit wat TRCA aan INSM hiervoor betaalt. Gezien de grote kans dat TRCA ook in Virginia bakzeil zal halen gaat INSM er uiteindelijk waarschijnlijk met een stevige pluk geld van TRCA vandoor. Dit kunnen ze dan weer stoppen in het (onvermijdelijke) hoger beroep in de patentenkwestie. Kortom: zodra TRCA INSM moet gaan betalen voor proceskosten drukt dat de proceskosten voor INSM bij de vervolgprocessen aangespannen door TRCA. Altijd handig.

i am a lawyer and your statements are not accurate. #1 was not accepted by the court. although they are in the same competitive market, the drugs were found to be 'different drugs' by the FDA and that was brought at evidence against TRCAs allegation. therefore any marketing materials for one, do not relate to the other. case closed. INSM can go after TRCA for $ spent on lawsuit. i also suspect virginia will be tossed right out. Stevige pluk geld weet ik niet, de proceskosten moeten worden betaald door TRCA, daar wordt INSM uiteindelijk financieel gezien niet beter door. Dit is anders wanneer de rechtbank een uitspraak doet over een schadevergoeding in het voordeel van INSM.

I believe the Virginia Court will agree with California that dismissed on two basis:
1) failure to state a claim [no violation of the law] and
2) no personal jurisdiction over INSM;

However, remember California was TRCA's corporate headquarters and Virginia is INSM's; although this case is in Federal Court supposedly a more neutral forum, this is a VIRGINIA Federal Court and the jury will be Virginians;

So TRCA'S chances are nil;

Furthermore, the California decision will provide an excellent foundation for the Virginia Court to dismiss likewise leaving TRCA the possibility for getting a judgment for all of INSM's legal costs and court costs incurred in BOTH cases; How low do you have to go TRCA; just my view.

Dat bedoelde ik te zeggen met een aantal post hierboven. Rechtbank was wellicht niet competent?

Dan had de zaak n.m.m. toch veel eerder zijn doorverwezen naar een bevoegde rechtbank. Dit heeft dan anders wel lang geduurd voor ze daar achter zijn gekomen!!
